Welcome to Brick Bay’s online store, event booking, and restaurant reservation platform. By accessing or purchasing from our website, you agree to the following terms and conditions. Please read them carefully.


1. General Information

1.1 These Terms of Service govern your use of our website, purchases from our online store, event bookings, and restaurant reservations.
1.2 By making a booking or placing an order, you confirm that you are at least 18 years old for alcohol purchases or event attendance where applicable, or have parental/guardian consent for all other purchases.
1.3 Brick Bay reserves the right to update these terms at any time without notice. Changes will take effect immediately upon posting to our website.


2. Products and Pricing

2.1 All prices are listed in New Zealand Dollars (NZD) and include GST unless otherwise stated.
2.2 We make every effort to display product descriptions, images, and pricing accurately. However, errors may occur. If a pricing error is discovered after you place an order, we will contact you to resolve the issue before processing.
2.3 Products and services are subject to availability. We reserve the right to limit quantities or discontinue items without prior notice.


3. Alcohol and Age Restrictions

3.1 By law, alcohol cannot be sold to anyone under the age of 18 in New Zealand.
3.2 By purchasing wine or attending events where alcohol is served, you confirm that you are at least 18 years of age. Proof of age may be required upon delivery or entry.


4. Orders and Payment

4.1 Payments are securely processed through Shopify’s payment gateway. Your payment information is not stored on our servers.
4.2 Orders and bookings must be made with accurate and complete information. Brick Bay is not responsible for delays, failed deliveries, or missed reservations due to incorrect details provided by the customer.
4.3 We reserve the right to cancel or refuse orders or bookings at our discretion, including but not limited to cases of suspected fraud or unauthorised transactions.


5. Shipping and Delivery

5.1 We deliver within New Zealand only.
5.2 Delivery times are estimates and may vary due to factors outside our control. Brick Bay is not liable for delays once the order has been dispatched.
5.3 Risk of loss or damage passes to the customer upon delivery. If your goods arrive damaged, please contact admin@brickbay.co.nz with supporting photos.


6. Restaurant Bookings

6.1 Booking Confirmation: All restaurant reservations made via our website are subject to confirmation. You will receive a booking confirmation email once your reservation has been successfully processed.
6.2 Cancellations:

  • Please notify us of cancellations at least 24 hours before your reservation.
  • For group bookings or special events, a longer cancellation period may apply and will be communicated at the time of booking.
    6.3 No-Shows: Failure to attend your booking without prior notice may result in future reservations being restricted.
    6.4 Special Requests: We will do our best to accommodate seating preferences and dietary requirements. Please include these details when booking or contact admin@brickbay.co.nz directly.
    6.5 Dietary Information: While we take care to accommodate dietary needs, cross-contamination cannot be guaranteed. If you have severe allergies, please inform our staff when booking and upon arrival.

7. Event Bookings

7.1 Tickets are valid only for the specified event date and are non-transferable.
7.2 Cancellations made up to 72 hours before the event are eligible for a refund, minus a $5 per ticket cancellation fee. Cancellations within 72 hours of the event are non-refundable.
7.3 Seating is at large shared tables. Requests to be seated next to other bookings can be made to Cherie at functions@brickbay.co.nz.
7.4 The menu may be subject to change without notice. Dietary accommodations must be confirmed with Cherie prior to booking.


8. Sculptures and Gift Cards

8.1 Sculptures should be inspected upon delivery. Notify us immediately if there is damage.
8.2 Gift cards are non-refundable and cannot be redeemed for cash.


9. Privacy and Data Sharing

9.1 We respect your privacy and are committed to protecting your personal information. Please review our [Privacy Policy] for details on how we collect, use, and store your data.
9.2 We use third-party tools such as Google Analytics, Mailchimp, Facebook, and Shopify Apps to enhance your experience. By using our website, you consent to the collection of data as per their privacy policies.


10. Governing Law

10.1 These Terms of Service are governed by the laws of New Zealand. Any disputes will be resolved under the exclusive jurisdiction of the New Zealand courts.
